NYC Federal Gang Crimes Defense Attorney

Manhattan Federal Gang Crime Defense Lawyer Representing Clients in New York City, Long Island, and Westchester County

The Criminal Street Gang Crimes statute is a federal law that adds up to 10 years to the sentences of street gang members who are convicted of certain felonies.

If you are convicted on a violent or drug-related felony charge, and prosecutors show you were acting on behalf of a gang, your sentence will be extended by up to 10 years, thanks to the Criminal Street Gang Crimes statute.

At The Trainor Law Firm, P.C., we defend clients who are accused of committing crimes in furtherance of gang activity.  We work diligently to minimize the negative consequences resulting from the underlying charges and the sentencing enhancement.

To speak to our founder, federal criminal defense attorney Craig Trainor, please call 212-300-6557 or contact him online.

Applicable Offenses

To trigger the Criminal Street Game Crimes sentencing enhancement, the underlying offense must be a drug-related felony or a felony involving force or violence. The offense can be either a state or federal felony. Examples include:

  • Murder and manslaughter
  • Assault and aggravated assault
  • Sexual assault
  • Arson
  • Drug crimes, including trafficking, distribution, possession and manufacturing

Our legal team will develop a two-fold defense strategy to avoid the sentencing enhancement.

  1. Address the Underlying Felony

We will work to get the charges reduced, the evidence suppressed, or the case dismissed. A former prosecutor, attorney Craig Trainor is an excellent negotiator who may be able to work out an optimal plea agreement. He is also a skilled courtroom attorney who is fully prepared to go to trial if that is the best way to achieve a positive outcome in your case.

  1. Fight the Sentencing Enhancement

We may be able to show that you do not meet all the criteria for the application of the Criminal Street Gang Crimes sentencing enhancement, which cannot be applied if:

  • You were not participating in a criminal street gang.
  • You did not know that the gang’s members engage in a continuing series of criminal offenses.
  • You did not intend to promote or further the activates of the gang or maintain or increase your position in it.
  • You have not been convicted within the past five years of certain qualifying felonies.

Our law firm can also represent you on racketeering charges that are frequently used against alleged gang members.

Mistaken Assumptions Can Lead to Arrest

We know that innocent people get charged with crimes they did not comment all the time. It is not against the law to be in the wrong place at the wrong time, to have a friend with a criminal record, or to be a member of a minority group. Yet people in these categories frequently get swept up in the system and charged with crimes.

At The Trainor Law Firm, P.C., we never make assumptions about our clients. We will treat you with dignity and respect. We will work vigorously to achieve a positive outcome in your legal matter.
